If there was no will, would the person who has power of attormey,become the executor of the estate

A person would be an agent of the principle. The agency ends on the death of the agent or the principal. So if you were the agent you are not once the principal dies.

Logically the agent would be a person who could petition the court to be the administrator of the estate. However, its not the only person who could.
