RI uncontested divorce

How long is the process of obtaining a Rhode Island uncontested divorce? Do iI need a lawyer to get a divorce in RI? How long will it take until its final? Does it take longer if there are children or custody issues?

When you file a Rhode Island (RI) uncontested divorce the clerk will set a "nominal" court date 65-70 days after filing. If everything is agreed to, the court will grant the divorce at the nominal hearing date.

Everything means all issues concerning custody, visitation, placement, alimony, real estate issues, payment of marital debts etc.

If everything is not agreed to on that date, the divorce may take up to a year or more to resolve. After the nominal divorce hearing it will take a minimum of 90 days until the final judgment of divorce can be submitted to the Rhode Island Family Court.

The divorce is not final until the final judgment of divorce enters.

The divorce process is an extemely important event in your life and I stongly urge you to retain a Rhode Island divorce and family law lawyer/ attorney.

It does not necessarily take any longer to resolve a divorce because there are children involved. It may take longer to resolve the divorce if husband an wife are in disagreement as to visitation, legal custody (joint custody or sole custody), placement, child support etc.
