Legal Question in Immigration Law in South Carolina

student visa

Hello, everybody!

I am applying for a student visa. My situation is as follows:

-I am married to an US citizen (no visa request being processed for a spouse status);

-I stayed almost one month over the student visa status, previously (I applied for a 1 month tourist visa, but was denied).

Could you, please, tell me what the prospects are in my situation?
