Legal Question in Family Law in South Dakota

getting money back

married 34 years, now divorced 3 years, my oldest son was so mad I divorced and he kept his children away from me for 3 years, I was so devastated I couldn't live a mile from them and not see them, it hurt so bad because I saw them every day and then cut off instantly, saw him Monday and talked and talked and he sweetly made my mind think it was ok to give him money so we could be a family so I did, 100,000, the next day I knew he took me, he had cashed the check already and now I am wondering if I can draw a civil suit or something to get that money back since he obtained it when I was in such a vulnerable state......?

Re: getting money back

you can surely recover your money back by making a demand; and if he refuses to meet the demand, you may approach the police u/s 406 IPC because any money or valuable delivered by the wife to her husband or his relatives in trust and they are required to return the same whenever demanded back. if they refuse to return, it will be a breach of trust making them liable for criminal prosecution.
