Constructive Trustee? What responsibility is expected?

The Decree states that if any asset that was not divided in the divorce now belongs to the other with the guilty acting a Constructive Trustee. Problem: the asset has improvements that the ex and new spouse are responsible for and it is in another state. I am assuming that at least the asset now belongs to me. Who will be responsible for the new debt incured against it?

You have a very unusual situation. I would imagine that even though there is debt on the property, the asset probably has equity. The Decree will need to be reviewed by an attorney before your question can be answered. If I can be of any assistance, my number is 901-527-9600. Good luck. MR
