Legal Question in Sexual Harassment in Tennessee

Sexual Discrimination

One job posted as 8 hours, originally held by one woman for several years. I did not bid on it. I already had an 8 hour job. It was filled by one man. First man said it was too much for one person. Another job with the same title was created. Description was changed to a 12 hour job. Second job not posted; second job given to another man without being reposted. I wanted the second job because the description had changed. Job was given to a second man (he originally bid on the 8 hour job but didn't get it) even though I have more seniority than he does, approx. 5 years and better qualifications. Is there a good chance for sexual discrimination? Would I have a decent chance of winning a case like this in court? More details available if you think I have a case.

Re: Sexual Discrimination

It is impossible to fully evaluate your situation with the limited facts supplied. However, based on what you have provided, you seem to have some the elements of what the law calls a prima facie case of employment discrimination. The more complicated question will come in determining whether or not you have sufficient proof to demonstrate that the reason the employer gives for not hiring you into the position is false.
