Legal Question in Credit and Debt Law in Texas

Foreclosure

My mother used the mortage to make some repairs on her home. The repairs were shabby and reported. The vent hood caused a fire and she had to repair. Now the mortage company that loaned the money has gone bankrupt and out of nusiness. A dept collector picked up the file and now threatens to foreclose on the property. She had beeen making payments until we were notified of the legal actions taken against the company. The people were only taking advantage of the elderly people. Is the foreclosure legal?

Re: Foreclosure

The foreclosure probably is legal. Your mother should contact a bankruptcy lawyer to help stop the foreclosure if it goes that far. In the meantime, she should try to work out a payment schedule with the collection agency to hold them off. She should also contact the Consumer Fraud Division of the Texas Attorney General's office concerning the matter, as soon as possible. They have an office in Houston.
