Legal Question in Credit and Debt Law in Texas

Repossesion question

I sold a vehicle on payment terms. In the promissory note I stated in the even of default after 7 days of demand the vehicle must be returned to the seller. Well he hasn't returned it. Can we go pick up the Vehicle? And if so should I let him get his belongings out of the vehicle or can I just pick it up without him knowing it to keep down confrontation? Thank you.

Re: Repossesion question

Are you shown on the title as a lienholder? If so, you shouldn't have any problems repossessing the vehicle. Any of his personal property in the vehicle must be returned if he asks for it.

If you aren't shown as a lienholder, you may run into some problems with the repo, such as being accused of theft.
