HGN Video as an expert witness

Before my DWI trail the DA said he show the jury a HGN training video to the jury. He told the court and my Atty about this video 5 mins before the trail. It was not mention in discovery nor was my Atty allowed to review the Video (except 5 mins before the trail). The judge (elected without law degree) in the case allow the video anyway. My Atty was very upset about this. Would this be grounds for an appeal?

You need to talk to your attorney about that, he would know better than anyone. However, I will tell you that he is not the only one that is happening to and there is no case law on the situation, and yes there are several attorneys (unknown to me) that are attempting to find away to take that up on appeal.
