Getting my husband out of the house.....I want out of our marriage. He is verbally abusive to me and my daughter and frightens us.

If you have a reasonable fear for your safety (has he ever raised a hand to you or threatened to harm you), you can get a protective order from the local DA's office at no charge to you. (He would have to pay for it - how good is that?) If you're serious, go now.
