Legal Question in Medical Leave in Texas

Where to turn..FMLA

Hello. I was certified FMLA in July 2006. Immediately, my employer began violating FMLA requirements and my rights under the protection of FMLA. Also my HIPPA rights were violated. I received no initial paperwork in response to the certifiecation. Immediately, my employer began permitting supervisors and coworkers to harass me and I was retailiated against. It became a very hostile working environment. My reasonable accommodation of no overtime was challenged with my full time hours being threatened as well. The protections granted by FMLA were given to two much younger employees who went out on pregnancy leave without enough time on the job to be eligible. They were both also given special shift accommodations and break accommodations before and after their return. They were in their early 20's and 31 years of age. I am 57. I was threatened to have my shift taken away and be placed on another shift due to exercising my rights, e.g., taking a day off for medical reasons affiliated with FMLA. I was intimidated and interfered with my taking off days for my illnesses. I was called into a meeting at the headquarters and in front of some administrative assistant was coerced into stating all my medications and illnesses. Please help me.

Re: Where to turn..FMLA

The sort of problem of which you complain cannot be resolved by a posting on an Internet message board as this is only a source of information about your rights.

You need to spend some time in a one-on-one consultation with an attorney to determine how to proceed to protect your rights. You will also probably even have to hire an attorney to represent your interests in dealing with the employer.

I have several links on my website, www.memphisemploymentlawyer.net that can help you determine if you need to hire a lawyer. You also can visit the site to find out more about FMLA rights and age discrimination claims. If you would like to discuss this matter in more detail with me, I can be contacted at [email protected].
