Legal Question in Civil Litigation in Texas

Landscape Company ran over waterline and sprinkler system

Landscape company delivered rock/sand via a dump truck to house. The driver was instructed by my wife to back into the front yard and unload. She informed them of the water line and sprinkler system control module and visibly showed were they were located. Driver backed into yard and ran over both the water main and the sprinkler control valve boxes cutting the water lines. Landscape company refused to pay for repairs and produced the unsigned bill with ''terms and conditions'' stating no liability for damages to property caused by delivery. Are they liable for damages to the property?

Re: Landscape Company ran over waterline and sprinkler system

That's a "maybe". Depends upon the contract you signed, and proving that the driver was negligent.
