Legal Question in Employment Law in Texas

Oral Contract

My wife interviewed for a job where she worked 6 years ago. She did fine on the interview and was offered the job the manager in charge of the section. The salary offered was $52K and was contingent upon a favorable background check and negative drug test. The background and drug testing yielded negative results. She accepted the job the next day for $52K. The following Monday the director (manager's boss) called and offered her the job but reduced the salary by $4K. Is there grounds for a lawsuit for breach of contract (oral)? This ordeal took place in Houston, TX.

Re: Oral Contract

An oral contract is not worth the paper it is written on. This would be governed by Texas law, but in most states you would need a written employment contract for such an offer to be actionable.

Re: Oral Contract

Hopefully it is in writing..defense would be she has to mitigate damages..etc..and no contract until signed, etc....not really economical in my opinion..
