Legal Question in Employment Law in Texas

I work over 40hrs get paid by comission, should I get paid overtime?

If I'm a full time employee, who many times works over 40hrs a week, isn't paid a yearly salary, not a supervisor and works on 50% comission yet not considered an hourly employee by the company.(even though it shows an hourly rate on my pay stub) If I usually work 10 hours overtime within a week, Is the company allowed to include the overtime within the comission I make or are they supposed to pay me overtime aside from the comission I made?

too complicated for a simple answer..visit an employment lawyer...but expect to be looking for a job when you contest the practice
