Legal Question in Landlord & Tenant Law in Texas

Breaking a lease

My father in law needs to move into an assisted living facility due to the fact that he is showing signs of alzheimers, however he has a current lease at an apartment complex and it doesn't expire until July 2008. How do we get him out of that lease?

Re: Breaking a lease

Generally, the lease will expressly set forth the langugage for early termination. Typically there is a requirement of 30 days written notice to be given to the landlord. If my law firm can assist you with this legal matter or any other legal issue, please contact my legal assistant Jennifer ([email protected]).

In addition to Mr. Brashear's advice, (read and follow the requirements of the lease for early termination), sit down with the landlord and have a heart-to-heart talk about the problem. Many landlords are human, :)and capable of understanding a difficult situation. They may be willing to work with you. If an alternate agreement is reached, get it in writing.
