Legal Question in Landlord & Tenant Law in Texas

My question is about this guy that I help to stay in my mom house while he looks for a house, buy the verbal agreement was to move out as soon as his personal finances got better now his wife and kids are staying with my mom and she want them to move out they been paying 200 dollars a month and helping with the water and elctricity bill they been living for five months in this property, now they have to move since my mom is not happy for their attitude of not looking for a house they just taking for granted the help can you evictem or is this like a rental contract agreement. This property is located in Texas. Thank you.

It there was no written agreement, the law presumes a month to month tenancy. Your mom can evict her tenant. However there are notice provisions in the property code that must be complied with. Suggest she see an attorney to assist her with the process.
