Re: slip and fall

I have successfully handled over 700 slip-and-fall cases. These are among the most difficult cases to prove and win. The reason is that the law requires that your mother, as the claimant, must PROVE three of these four elements:

1) that the store put the water and/or fruit on the floor; or

2) that the store, even if it did not PUT the water and/or fruit on the floor, nevertheless KNEW the water and/or fruit was on the floor BEFORE her fall; and

3) that the store failed to WARN her of the danger; and

4) that she was not negligent herself by failing to watch where she was walking.

Also, remember that the store does not have to disprove anything; it is your mother's burden to prove every element of her case.

As you can see, these are very difficult cases to prove and win. If you have any evidence that the store knew the water and/or fruit was on the floor prior to your mother's fall, I would be happy to help her with her case.
