child custody and visitation

I have a minor child where there is no legal custody documentation, custody right now is with whom is in possession of minor. Minor child's parent was witnessed giving alcohol to child, could I legally withhold parent time until custody hearing is held?

Custody defaults to the child's parents. If a parent gives alcohol to a child contact DCFS, Child Protective Services. Either parent can seek an order restricting or stopping contact by a negligent parent. A non-parent can seek custody if there is no competent parent.
