fraudulent misrepresentation

If I wish to file criminal as well as civil charges against a family member for fraudulent misrepresentation, do I begin in the state of North Carolina where that person resides or do I begin in the District of Columbia where the incident took place. The incident in question is regarding the fraudent activity of a family home sale.

Re: fraudulent misrepresentation

You could contact the U.S. attorney's office in DC regarding a possible criminal case, but having practiced criminal law in DC for quite a few years, I have doubts that this office would be much interested in criminally prosecuting this type of case, particularly in view of the fact that the potential defendant is apparently no longer within the jurisdiction.

Your civil claim could likely be filed in the appropriate court in North Carolina or possibly federal court in DC or Virginia(if that's where you now reside)if diversity jurisdiction has been found to exist. However, needless to say, you will want to consult with attorneys who are appropriately knowledgeable and experienced in civilly prosecuting

such matters as fraud or related matters in the aforementioned courts.
