Legal Question in Real Estate Law in Virginia

Property Damage

My car was repossessed over the weekend and in the process my yard was torn up very badly. (The car was not parked in the yard, it was parked in the driveway.) There are deep tire marks in several different places and it will need to be leveled and reseeded in a large area. Obviously I don't have the money to do this or I could have paid to keep my car. Are the recovery companies allowed to damage my personal property? They also didn't even take my son's car seat out of the car when they took it. I understand they try to leave before someone comes out to confront them, but when you have a child that obviously still needs to be in a car seat, shouldn't they at the very least have to leave that? Thank you.

Re: Property Damage

You would appear to have a viable claim for any damages caused to your yard through the negligent actions of the repo company as well as a claim for

your son's car seat(either for its return or appropriate indemnification).

You could file your claim in small claims court for around $30 and prosecute it without the need for an attorney as attorneys are not allowed to

practice their profession in the small claims courts of the Commonwealth.
