Legal Question in Traffic Law in Virginia

License Suspension

My Fiance was involved in a minor fender bender a few months ago, and in court was told to take a driver improvement course or pay a fine. She opted to take the class and completed it with ease. Well, about a month later she recieved a notification from her insurance company that she was having her policy revoked immediately because her was license suspended. So she called the DMV and apparently, her license had been suspended for a month already, even though she recieved NO notification. Her license was suspended because the instructor at her class never sent her form in stating that she passed and when she took her form to the DMV herself, they informed her that there was nothing they could do, and that she must pass a written exam now AND pay $75! All because someone else never did their job. She was NEVER informed in court that she would lose her license if she failed to take the couse, she was NEVER informed that she even lost her license, and now its apparently her responsibility to make sure that someone else does there job and sends in her course completion notification. I'm curious to know what kind of legal avenues we can pursue with the state to fix this of AND that she gets her policy back without any rise in rate.

Re: License Suspension

Your friend should've demanded a written acknowledgement from the school regarding their failure to submit the necessary documentation, not just a copy of the completion certificate.

If she hasn't already demanded such documentation, she should now do so and send a copy to her insurance company and the DMV with an appropriate cover letter requesting whatever redress may be reasonably called for from each

under the circumstances.
