Legal Question in Civil Litigation in Washington

Theft at school!

ok so today

someone stole my new ipod touch 8gb at school

they got caught because someone saw them take it

my ipod was in a case, had the screen protectors still on it, was in mint condition!

i finally got it back

and the protectors are gone, and there are scratches ALL over it !

i told the police at my school that its damaged and he said that technically its only ''damaged'' if it doesn't work anymore (which it does).

they said he will be charged with a felony (since its worth over $200) and taken to jail

but i am really pissed because there's tons of scratches and the protectors are gone now and i want it fixed or a new one

i think that i have the right to a new one

what can i do??

or what rights do i have?

also he is a minor (hes 16) and we live in WA state if that helps

Stay in touch with the prosecutor on the case. They can ask the judge for restitution, money to you to repair the damage or equal to the value of the damage. Another option, after the conviction (because that makes the proof easier) you can sue him in small claims court.
