Legal Question in Family Law in India

Dear Sir

A few doubts regarding my rights and finding the right advocate.

I am preeti 26 female married from kerala. I am basically an adopted girl to a kerala couple, me originally from gujarat ( as heard from my foster mother otherwise the only clue is the sort of birth certificate written in gujarathi lipi once shown by my mother which is under her custody.

They adopted me in 1989, while they were in dubai, taking a passport with place of birth as mumbai and i was brought up in dubai after.During the time of my marriage in 2010 - arranged, they have shown my husband bond papers of worth 50 lakhs deposit on my name to him along with nearly 1 kg gold. the gold is under their custody and the interest of 30000 we use to get as a maintainance now stopped after 3 - 4 times.

now for some ego clash they closed the relation with us, we having no money and gold. lot of sufferings i m going through as she is also withholding my id proofs and certificates too. As an adopted child cud i have a recourse to these riches she has agreed upon the time of marriage, they have no children otherwise and no properties but only liquid money of crores of deposit and a villa which they have acquired and not inherited. Please advice and help us find the right advocate thanks, preethi

Hi Preethi.

First of all, you should forget about your being an adoptive child. Once adopted, a child is at par with any other child born in the family and the adoptive parents are at par with 'natural' or biological parents.

Yes, you can claim your money - gold, cash everything, not only because you are their child; but also because these properties are part of your 'istridhan', if given to you at the time of marriage.

Any property, given to a girl/bride at the time of marriage, becomes her 'istridhan' [exclusive property] and she is entitled to demand return of the same, if it is kept by her relatives.

For the time being, you should send them a written registered letter demanding your money and gold. If you so desire, you may send a draft letter to me by email.

All the best,

Goel
