Legal Question in Real Estate Law in India

we live in a semi complex where in two separate addressed stand alone buildings made by the same promoter in the same time. It was verbally mutually decided by most members not to construct boundary wall in between the buildings in order to have a common caretaker . This planning is still followed since August ,2005,but for the last 3months 3 members in a building are not paying their maintenance charge even after several requests. but their Tenants are getting all service.

Please advise ,how the maintenance charges be recovered legally?
