Legal Question in Criminal Law in Alabama

Yes I wrote a check to a car lot and they was suppose to hold the check for two weeks but they did not they turned it in and charged me and my husband both with theft by deception in the first. My husband name was not on the check or on the paper work can they chage him. His court Appointed lawyer talked him into pleading guilty but he is mental and we have his medical records stating that. The guards where he is says he can file a claim against the county for wrongfully arrest and charge. All he done was take the check in there to the car lot. But the sales person knew there was no money in the account and I was waiting to get the money my mom was giving me off her settlement off her husband. We have four small kids7,6,5,and4. He got a 10 year sentence and i got five years probation.

You got some major problems and need to see a lawyer. There is not enough information here. Particularly important is how long has it been since he plead guilty?
