I am trying to get custody of my five year daughter. My ex wife and myself have joint legal custody at the present. My exwife has just filed on May 9th for her eight divorce and is engaged to get married for the ninth time. She has previously brought charges against me for mental abuse to my child which was inconclusive through Department of Human Resources. Could you point me into the direction where to find some cases where the parent was unstable in their marriages and the effects it had on the children. Also I am not remarried and she was my second marriage. I thought I was here third but later found out in depostions that I was the sixth. The charges were done mainly to hurt my carrer choice. I am working on my Masters of Education, hopefully to teach school. But untio I get my name off the DHR register of being investigated it will not look favorable for myself. I am presently asking for an Admistative Hearing through Montgomery.

You will have to prove a lack of stable home and environment. The McLendon Standard would apply which means that since the last custody determination, circumstances have changed such that the health and welfare benefits to the child would more than offset any inherent disruption caused by a change of custody.
