Legal Question in Personal Injury in Alabama
Car accident
On Sept 30, 2007 my wife was involved in an accident. She was traveling south on a highway when a maroon truck or SUV ran stop sign almost causing impact. She swerved right and ended up in a 20 foot ditch and totaled our vehicle. We only had liability at the time. She was rushed to ER by ambulance and admitted. She identified the driver but he put his self on the police report as a witness stating that he was a the stop sign when my wife's vehicle crashed. Police also stated the someone had to cut her off because of tire marks at intersection. The other driver is denying being at fault. There was only 2 witnesses on the report. The other withness do not remember anything about the other vehicles position but stated that by the time he crossed over to see what happened the accused was already parked across the street and in the ditch to help my wife which also seemed questionable to him that the guy was involved. My question is are we able to recover from this guys insurance company or is this a lost case. My insurance medical limit is 3000. Can this guy be held liable for my wife accident if it places him on the scene and also he own a maroon suv or my wife described running the stop sign.

I believe you will have to file suit against this individual and proceed to trial. As in most motor vehicle accident cases, your success will depend on which version of the story the court believes.
