Legal Question in Wills and Trusts in Alabama

Do I need to probate?

My aunt passed away last week. She had no children, my mother and I took care of her; she also has a brother. The only property we did not get taken care of before her death was her car. She had told us to try to sell it ( I had her POA). What do we need to do to sell the car, if that is what we choose to do?

First of all, the POA terminates at death. If the car is truly the only asset in the estate, I would recommend calling the car title office in the county of your aunt's residence to obtain a copy of the form needed to transfer title without an estate administration. You may also be able to obtain a copy of such a form on the county's website. Good luck!
