Victim of Criminal Aggravated Assault

I am a victim of a criminal aggravated assault. I have filed criminal charges and am confident the perpetrator will be found guilty of these charges. Am I entitled to also file civil charges against this person. I was assaulted by this person drawing a rifle and threatening to blow the back of my head off. Since this ordeal has become a life altering situation am I entitled to sue this person in a civil court? Could the property owner, not the perpetrator, be held responsible in a civil action? If this perpetrator come from a very well known upscale family in the city, how do I go about getting legal representation, without a conflict of interest, without revealing my intentions first?

Your question is quite a complicated one. Let me make it simple, you can absolutely attempt to recover in a civil action. You also have victim's rights under the Arizona Constitution that affords you the right to be made aware of what is happening in the criminal case, which of course may have a bearing on the civil action. As for the property owner, certainly you may be able to recover, including him in the lawsuit, depending on the facts of the case. He would eventually be made aware either if you approach his insurance company and/or file a civil lawsuit. Unfortunately, it is hard to answer in any more detail without having additional facts.

Hi,

Yes, you may sue if you have a good case but be careful because you do not want to be bringing any frivolous cases. We need to determin your damages before going forward.

The landlord may be liable in certain instances but that depends on so many issues.
