Real Estate Commissions

The real estate brokerage I've been selling for has recently split from the home building company we've been representing. I am considering leaving my brokerage to work directly for that home builder, who has subsequently established their own in-house brokerage.

I still have several deals that are not yet closed, thus I have not been paid my full commission on them yet. To complicate things further, my current broker made all the salespeople sign a paper recognizing that we would forfeit our remaining commissions if we were to leave or be fired.

As an independent contractor, aren't I owed my full commission for having made those sales?

The commissions belong to your broker. Whether the broker has to pay you depends on the contract that you have with your broker. Bring to the contract to a lawyer to review.
