i figure anything can happen at any time so even though i am still young i should probably write a will. can i just write something up and sign it? or are there certain rules or paperwork that has to be done? does it have to be witnessed by an attorney or a notorizor person?

Re: writing a will?

Congratulations on being realistic and responsible, because you are absolutely right, anything can happen to anyone at anytime.

You can handwrite your own Will, so long as it is signed and dated. I do not recommend this because without professional advice, there are most likely many things that will be left out of the Will that you would have wanted, if you knew about them.

If you use a form or an internet service, again you will most likely not know to include important provisions in your Will, and you must have witnesses and a notary at the execution of the Will.

Even more important, you should have a Durable Health Care Power of Attorney, so someone you choose can take care of you, make medical decisions and have access to your medical records, in the event that you are unconscious or otherwise incapacitated. It is not very likely that you will die at a young age, but the risk of being in a car accident or some other situation where you need someone to act on your behalf, is much greater. Please consider this, and get counsel on your Will preparation.
