i loaned my truck to a friend. He then had an accident that killed someone. Whose liable?

If he was at fault in the accident, you, actually your insurance company is liable for up to $15,000 per person or $30,000 per accident, and your insurance company will give you a free lawyer to defend the case. If he did not have a driver's license or was intoxicated when you loaned him the truck, you could be liable in unlimited amounts for what is called "negligent entrustment." Call your auto insurance carrier right away.

You also need to find out from your insurance company if they provide coverage for casual usage by others of your vehcile, whether he has any insurance coverage, what criminal charges have or may be asserted against him. If you have a $15,000 policy and they accept coverage, if there is any hint of your friend being at fault for the accident your insurance company will probably offer the policy limits to get the case against you settled. The insurance company has to look out for your interests, which is to reach a settlement so that you are dropped from the case. If your friend has insurance that covers him for the accident then your insurance company might not have to pay out anything. If you insurance company does not act in your best interest, as opposed to acting in their best interest, ;you may be entitled to so called "Cumis" counsel where your insurance company has to pay for which ever attorney you select [within reason].
