Legal Question in Bankruptcy in California

Student loans, Chapter 7, 1996

I filed for bankruptcy in May 1996, now the federal government says I owe $40,000 -- although the loan was included in my bankruptcy. Does Section523(a)(8) apply to me in 1996?

In 1996, the student loan would have been discharged if the loan were in repayment status (default or not) for at least 7 years.
