Legal Question in Consumer Law in California

Unauthorized inquiry in my credit report

A collection agency has been after me for at least 20 years on a default credit card payment issued by first interstate bank in 1981 for $2000. I have credit monitoring service that emailed me an alert that this agency has placed an inquiry in my experian credit report on 3/16/07 without my consent, permission or authorization. Do i have any legal recourse to obtain monetary compensation?

Re: Unauthorized inquiry in my credit report

Write to the 3 credit reporting agencies disputing the debt. Also, the statute of limitation is 4 years after the last payment or when it was due, whichever is later. Sounds like the statute has run. They might be violating the federal Fair Debt Collection Practices Act. Is it worth it to sue? Perhaps, if you put them on written notice that it is a debt that is uncollectible, that the statute of limitation long has run, and the bank has been out of existence since the mid 90's.

Have you suffered damages due to the inquiry? There are general damages available under the Fair Debt Collection and Reporting Act. Call me for assistance.
