Legal Question in Credit and Debt Law in California

Collections

Hi. I collection agency is having an

attorney sue me for a past due

amount on my credit card. The

attorney has filed suit in superior

court and a settlement conference is

set for July. I would like to make an

offer to settle on this debt now but

not sure how to go about doing this.

Re: Collections

Communicate only in writing. Prepare a letter offering to settle for whatever amount & explain why the credit card company should accept that amount. Give them x number of days to accept that amount. But, since you are not an attorney, BE VERY CAREFUL in explaining why they should accept that amount. You may innocently say something that could come back to haunt you. I would have an attorney prepare the letter or seek the advice of an attorney before you send the letter.
