Legal Question in Criminal Law in California

I was accussed of assault with a deadly weapon and this was fabricated through motive. The story was not told as it happened and and allagations are false. My girlfriend and I were assaulted and fled for or safty. Not only did they file report three days after the incident but the police report says crime was committed on 7/25/08, but I was there on 7/24/08 and have phone records and other documentation to proove this. I have a strong alibie. How can any of this report be credible in court. Is this means for dissmisal ?

I would recommend hiring an experienced criminal defense attorney to represent you. Even if the charges and evidence don't seem strong the prosecutors are experienced at this and it can be difficult to get charges dismissed without the proper knowledge. An experienced attorney will study the evidence and argue all the facts and law to fully represent you.

Unfortunately, the way the system works unless you have a good lawyer (private or public) working hard on your behalf the case is not likely to get dismissed. Once the case has been filed, the prosecutor is already invested in getting a conviction. A good defense attorney can help you in ways that you will not be able to accomplish on your own. The best thing you can do for yourself is to speak to a good defense lawyer. To find a good lawyer you will want to speak to several and ask detail questions about their trial experience and how they would approach the case. If you can't afford a lawyer, there are many good lawyers working in the public defender's office.
