Legal Question in Criminal Law in California

My boyfriend is charged with PC289(A)(1) by the state of California when all I did was call for help in a dispute over a broken phone. I filed no charges... There was a pattern of manic and depression with doctors records, calls by other family members due to his anger issues as well. There is no evidence of this charge except me describing a incident prior to my 911 call about broken phone. I was describing incident to show that he has a patter of (maybe) mental illness to be addressed, not the felony charge! How do I help in getting charges dropped?

After almost 30 years handling these types of cases, and being a Former Deputy District Attorney, I can tell you that your story is not unusual. Many times people call law enforcement and don't expect the hell that follows, and, in many cases, the government taking the matter much farther than you ever expected. The best thing you can do is get him a very experienced law firm to fight the charges. Many criminal defense attorneys offer free consultations, so I suggest calling a criminal defense attorney and let the expert go over the case and give you direction. I'm sure that once to retain the right firm, things will begin to move in a better direction.....I hope that helps.....David Wallin

Once police respond to a domestic violence call, someone is going to jail, period.

Hire him a good attorney and work with the attorney as requested.

If he doesn't know how to represent himself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will defend, try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help fight and get the best outcome possible, using whatever defenses and sympathies there may be. Ive been doing these cases for many years.
