Legal Question in Criminal Law in California

Penal Code 508

I received a letter for my court appearance and i am being charged of violating section PC 508, i work at the airport and was caught on video opening a bag, i took out an item from the bag but i didn't keep it, i dropped it on the ground and just kicked it under a baggage belt, i never had any intentions of taking it in the first place nor for me to come back for it, it was a stupid mistake that i opened the bag.

You need a lawyer. Now.

You have been charged with embezzlement. If you really didn't intend to keep the item then you aren't guilty of this particular crime, but you are still guilty of theft or some other lesser offense. If a jury would believe that you intended to take the item, then you will need a skilled defense attorney to persuade them that there is at least a reasonable doubt.

Re: Penal Code 508

In a nutshell - you need to defend yourself. 508 conviction would have very serious consequences to your future, not to mention that you might be facing jail time.

There are no short cuts here although having a clean record, if you have such, would be extremely helpful to your case.

Call a couple of attorneys to see who might be right for you.

Re: Penal Code 508

If you plead guilty and are convicted you won't work again, and certainly not at an airport, so you have a lot to lose. Please feel free to call me if you are interested in fighting the charges. Make sure the attorney you hire is on board well in advance of your FIRST court date.

You r attorney will use whatever facts and evidence is available in your defense of these criminal charges. You'll try to force the prosecutor to the point they recognize no theft occurred. If serious about getting legal counsel to help you do this right, feel free to contact me. I've been doing these cases for over 30 years.
