is it legal for one parent to move child out of state without the other parents permission?

If you have a shared parenting order that requires your consent then the answer is the other parent violated an existing order. If your timeshare is limited and there is no express order in your parenting plan prohibiting the move, the situation will be driven by the specific facts of the case.
