Legal Question in Family Law in California
I married my husband in Aug. 19, 2006 and we discovered that he was still married in Mexico, the Judge didn't sign the divorce until later? We want to stay married, but how do we go about this? Do we remarry or do we need to get an annulement?

Your second marriage is void on the grounds of bigamy. You can remarry, but not until the first marriage of his is terminated by a lawful decree of divorce.

If the first marriage was annulled, you may not have to remarry, otherwise, you would have to remarry after the first marriage officially comes to an end.

You will need to get remarried. The first marriage between you is void as he was not able to get married until the first marriage was ended by the judge.
