Legal Question in Family Law in California

Prenuptials

I am getting married in Nevada but will be residing in California, where I now live. Which state should a prenuptial be written and agreed upon; California or Nevada?

Re: Prenuptials

In the event of a divorce, your prenup will be interpreted in accordance with the laws of that state unless you specify otherwise in the agreement. If you are going to live in ca then it will probably be more convenient to use ca law. There are other requirements that must be followed for it to be valid in ca so consult a lawyer. Don't just rely on a prepackaged form.

In a general sense, if you file for dicorce in California, your Pre Nuptial Agreement will be viewed under California law, which has some very unique requirements.

For a specific opinion regarding your unique circumstances, you should consult with an expoerienced family law lawyer. Experience is not expensive... It's Priceless!
