Legal Question in Family Law in California

Restraining Orders

An OTS on a TRO was issued on 7/11/03 And the attorneys that were handling the caes just keep getting it continued. on 2/2/04 the minute order says that the restraining order will expired on that date unless the court reissues it. they did not reissue it but the hearing was continued until 3/26 04. and on that date it wasn't ressiued. and the case was again continued untill 4/26/04. on 4/21/04 the attorney file of a motion to be releived as attorney, and had the case continued once again until 5/26/04. on 5/26/04 without having any counsel present, the court issued a three year restraining order on me. My question is, How much time is their from the time the complaint was issued until the tro is to be heard. and also, Can the court issued this after it was said to expire 3 months prior. thank you C.P.

Re: Restraining Orders

The information which you provided are insufficient to respond. However, if the court issued a clets restraining order for 3 months, the protected party can request that the order be made into a 3 year restraining order by submitting a request to the court with a declaration stating facts which show that she is still in danger.
