Legal Question in Civil Litigation in California

For a sports competition, the governing body is asking for a "non refundable registration fee" for which a competitor is not guaranteed a selection spot #only two potential spots, five possible competitors#. Is it legal for the governing body to keep the fees of the three competitors who were not selected?

Sounds like an illegal lottery to me.
