Legal Question in Immigration Law in California

Hi,

I am on H1-B. I have 15 years of education from India and 12 years of USA work experience. As you know that 15 years or 3 years of collage cannot qualify for EB2 catagory. but I have 12 years of US wor experience. So AM I qualify for EB2 catagory?

Unfortunately, USCIS has made it very clear in Memorandum that it will not accept a 3 year degree from India + 5 (or more) years experience for the EB2 category.

You might be able to find these Memos on the USCIS website at www.uscis.gov. Or, contact an immigration attorney in your area for more information.
