Legal Question in Immigration Law in California

Query on present occupation in DS156 visa document - Please help

I have an unique problem. My father was forced to resign from his job under threat , for which he is fighting a legal case with his employer maintaining that he has not resigned. This case has been going on for several years. So even though now he is past the retirement age he still maintains that he is employed since no legal decisions has been reached yet.

For this reason he will not be able to state his occupation as retired. But if he states his occupation as ''Employed'' then he will not be able to provide any leave or other such relevant documents as there is no question of getting them from his employer now . What documents then shall he provide to justify his employment status so that tourist visa is granted to him.

Will be really oblidged if you could asnwer my question ASAP.

Your question is extremely confusing. If your father has a legal battle regarding his employment in California, why the heck would he need a tourist visa since he's already here? This doesn't make any sense!
