Carrier Insurance Dispute

Okay quick question. I had a trucking/carrier company for 3 years. Being a carrier means you need to have an insurance to cover your Loads. I had a guy who had 3 trucks and wanted to work for my company, which means he would have to be listed under the insurance. I gave them the # to my ins. and they contacted them and fraudently added themself to my insurace. They forged my name on the company check and got the insurance. The down payment was $7.5K ....They ended up not following thru and not working for me. They put a stop payment on the check 2 weeks after, and decided to go with another carrier and insurance company. Now my insurance company filled a lawsuit against me for the 2 weeks they had insurance for $10k....what should i do. Thanks

Defend aganist the lawsuit and cross-complain against the guy for recovery.
