Bonus pool not for all employees

I work for a UK Company and they have a bonus pool based upon company acheivements. My sales results go into the company accounting resutls. Last year which ended in April 2004 there was over $100k paid out to employees from the bonus pool. The 2 people in the US office were told after we saw this year's Bonums Scheme that we were not part of the bonus pool. We were told that when I was recruited any element of Company bonus was built into my salary. The scheme has been in existence since before I joined the Company and my coworker exclusion from it was built in to his total remuneration package for the US.

Neither of us was aware of this and only found out from a company email stating what the policy was for 2004/2005.

The policy states you must be in the UK and be on the payrole when the bonus is being paid. I have been with the company for 3 years and my coworker for 10+!

We want to know if this is legal in CA to be exepmpt from bonus pools like this?

Your terms are defined by your contract here, not by what happens in some other country.
