Legal Question in Employment Law in California

Hi,

How far back can an employer do a background check on a potential employee in California? and can information gotten from a "Google check" be used against you? especially from unofficial internet source?

Any employer that doesn't do a thorough background check is irresponsible. Many are using google, facebook, etc to check out present and potential employees. All perfectly legal. If you don't want somebody to see something about you, don't it or publish and brag about it. Criminal records, evictions, lawsuits, etc., are all part of your permanent record, and are the natural consequences of your behavior that the employer will evaluate.

An employer can interview your mother's OB/GYN to see if you were a problem birth if they want. Other than prohibited discrimination, an employer can base its hiring decisions on anything they think is relevant, no matter how stupid, old or unfair.
