Legal Question in Employment Law in California

My spouse is a shift cordanaiter two days out of the week, an employer will not hire me because he said my spouse is a shift cordanaiter. We told him we will work diffrent shifts and he still said no. I feel as though I'm being discriminated against because he has other employees that work for him that a related or they are in relationships and they even work the same shifts, when I asked to work there he told me no and then turned around and hired a mom and daughter that work togather on the same shift so I feel I am being discriminated against for who I'm with and not for who I am and how I work even though they say they are EOE. AM I right that I feel discriminated against and if so what steps should I take?

Discrimination is actionable only if it is based on an identified criteria under the law, such as race, gender, sexual orientation, religion, or military status. I see nothing to suggest discrimination on that basis. Absent other facts, the "discrimination" you discuss does not give you any rights to enforce.
