Legal Question in Employment Law in California

What is the statue on wrongful termination?

I have been working for a company for over five years. Prior to my wrongful termination I was working 12-16 hour days with no breaks managing a store. Can you please tell me what the statue is on wrongful termination suits? Also can I ask for reinbursement of vacation time I was never allowed to use? Thank you for your help.

Re: What is the statue on wrongful termination?

In California you have one year to file an action for wrongful termination. If it is for breach of a written contract, the action can be filed within four years.

You may be entitled to payment for all unused vacation pay, and, if your managerial duties were less than 50% of your work [the other 50%+ being non-supervisory], you may have a claim for overtime pay going back three years.

If you are in the Los Angeles area, you can call at 213 386 3860.
